8. Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law. PLAIN LANGUAGE VERSION: You should be able to ask for legal help when the rights your country grants you are not respected. Illustrated version NOTES: While the law and the constitution may provide you with fundamental rights, this does not mean that these will always be respected in every case. If a certain right is violated, you must always be able to turn or appeal to a 'competent' court. DEFINITIONS: competent refers to courts that serve a certain area of the law. For example, a person who claims that his or her rights have been violated in school should be able to petition a court that specializes in this question and not a court which deals, say, with business law. |

Even with courts in place, people's human rights are not always respected. Often non-governmental organizations monitor these situations and offer their help to people whose rights may have been violated in a specific field. Find out if there are any non-governmental, legal or advocacy groups in your town or community. Contact them and find out what they do. Whose rights do they protect? How do they do this? Can you help? |
